1. Who we are

The PostingClips website and application (postingclips.com, together the “Service”) are operated by CULOAREA DIN VIAȚA SA S.R.L., registered office Sat Topliceni nr. 214, Com. Topliceni, jud. Buzău, 127630, România, tax ID (CUI) 44820819, Trade Register no. J2021001108100 (EUID ROONRC.J2021001108100), a company that is not registered for VAT (the “Supplier”, “we”). Contact: contact@postingclips.com.

These Terms and Conditions (the “Terms”) govern the use of the Service and every purchase made through it. By creating an account or placing an order you confirm that you have read and accept the Terms, the Privacy Policy and the Cookie Policy.

2. What the Service does

PostingClips is an online platform that lets you:

  • generate vertical video clips with artificial intelligence (“AI”) models from a written description (an idea), optionally with a presenter (character);
  • pick footage from our video library (sourced from third-party free-licence libraries), which becomes your clip;
  • upload your own clips (MP4, MOV, WebM) and photos;
  • edit clips in a video editor (cuts, texts, graphic elements, music and sound effects, transitions, aspect ratios), optionally with an AI assistant;
  • connect social media accounts (TikTok, Instagram, Facebook, YouTube, X, LinkedIn, Threads, Snapchat, Bluesky) and publish clips straight away or at the date and time you choose, one by one or planned in the Calendar, with AI-written captions for each account;
  • create automations (“Automate”) that make new clips on the schedule you choose and publish them to the accounts you pick;
  • see post statistics (views, likes and so on, where the platform provides them) and read that data through a read-only API key.

Connecting accounts and publishing is done through a specialised publishing provider, using the platforms’ official interfaces. Available features, formats and limits vary by platform and may change when the platforms change their rules or interfaces.

3. Your account

  • You create an account with an email address and password or by signing in with Google. You must be at least 16; if you are under 18 you may only pay with the consent of a parent or guardian.
  • You are responsible for keeping your credentials confidential and for the activity in your account. Tell us immediately at contact@postingclips.com if you suspect unauthorised use.
  • The information you give must be accurate. An account is personal; if you use it on behalf of a company, you confirm that you may represent it.
  • You can close your account at any time from Account settings → Delete account, or by writing to contact@postingclips.com. Credits left unused when an account is closed at your request are not refunded, unless the law provides otherwise.

4. Prices, credits and connections

Prices are shown on the Pricing page and on the Credits page of your account, in euros (EUR). The price shown is the final price; the Supplier is not VAT-registered, so no VAT is added. Credits are a one-off payment; account connections are a subscription with a monthly recurring payment, described below. You can buy:

  • Credit packages (one-off payment). Credits pay for the actions that use resources; the rest of the Service is free. The cost of each action is:
    • AI-generated clip (“From an idea”, including in Automate): the price depends on the video model chosen and the clip length, starts from 3 credits a clip and is shown before every generation;
    • clip from the footage library that you pick: free; in Automate, a “library”-style clip (library footage with AI-written text): 2 credits;
    • clip you upload (from a computer or phone): 1 credit per video, for storing the file; if the upload is not completed, the credit is returned automatically. Photos uploaded in the editor are free;
    • presenter: free when made from your own photo; 5 credits when generated with AI;
    • the video editor and saving edited clips: free. The AI assistant in the editor: 1 credit for a written command, 3 credits for the automatic edit (“Edit automatically”), 2 credits for a clip’s automatic subtitles; credits are only taken when the action succeeds;
    • publishing and scheduling posts: free (an active connection is needed for the social account, see below).
    Credits do not expire while the account exists and are not part of any subscription. If a clip fails to generate, its credits are returned to your account automatically. Credits have no cash value, cannot be transferred and cannot be exchanged for money.
  • Welcome credits (a free, limited promotional offer). While the offer is open and shown on the site, a new account receives a number of free credits once, after confirming its email address (or straight away when signing up with Google). The offer is only given to a limited number of new accounts created after it was launched, once per person (the same email address does not qualify again, even after the account is deleted and created again), and may end at any time without notice, without affecting credits already received. Welcome credits have no cash value and cannot be refunded, transferred or exchanged for money; they are used like any other credits (clips, uploads, AI in the editor). They do not unlock Automate (new clips made and posted on their own): it can only be switched on after the first paid purchase (credits or connections).
  • Account connections (monthly subscription): one connection keeps one social account connected, with unlimited posts. The price per connection drops with the number of accounts (each account is charged at the tier it falls into); one subscription can include 1 to 200 connections. Connections renew automatically every month, with a recurring payment, until you cancel, so your accounts stay connected without interruption. If you disconnect a social account, the paid connection stays free and you can use it for another account until the end of the paid period; disconnecting does not cancel the subscription.

The connections subscription. The first period is paid at purchase; then, at the start of each one-month period, the subscription price is charged automatically to the payment method saved with Stripe and the connections are extended by another month. You receive an invoice for every payment and a confirmation email. You can cancel the renewal at any time, from Account settings → Subscriptions (the “Cancel renewal” button) or by writing to contact@postingclips.com; the cancellation takes effect at the end of the period already paid: the connections stay active until then, nothing more is charged, and then the social accounts are disconnected automatically. Until that date you can resume the renewal from the same page. No partial refunds are made for a period already started (except for the right of withdrawal in section 6, where it applies). If a renewal payment fails, Stripe retries it automatically over the following days and we tell you by email; the connections stay active for a few days, and if the payment does not succeed the subscription ends and the accounts are disconnected. Connections bought as a one-off before the subscription was introduced stay valid until their expiry date and renew only if you expressly turn on automatic renewal from the “Credits” page (the first payment is then taken when they expire). We warn you in the app and by email before connections that do not renew expire.

We may change prices for the future; a change never affects orders already paid, credits already bought or the subscription period in progress. A change to the subscription price applies only from a later renewal and is notified by email at least 15 days in advance, during which you can cancel the renewal.

5. Payment and invoice

  • Payment is made online by card (or the other methods offered) through Stripe, on the secure Stripe Checkout page. We never receive or store your card details.
  • The contract is concluded when the payment is confirmed. Credits are added, and connections become active, immediately after the payment is confirmed. For the connections subscription, by paying you agree that Stripe keeps the payment method and charges the price automatically at every monthly renewal, until you cancel.
  • For every paid order we automatically issue an invoice, through our invoicing service, from the billing details entered at payment (name, address and, for companies, tax ID). The invoice is submitted to the Romanian RO e-Factura system where the law requires it and can be downloaded from Account settings → Invoices. The invoice carries no VAT, as the Supplier is not VAT-registered; the amount invoiced is the amount paid.

6. Right of withdrawal (consumers)

If you are a consumer, you generally have the right to withdraw from a distance contract within 14 days without giving a reason, under Romanian Government Emergency Ordinance (OUG) no. 34/2014. However, the Service supplies digital content not delivered on a tangible medium and digital services that start immediately after payment:

  • Credits: under art. 16(m) of OUG 34/2014, the right of withdrawal does not apply to digital content not supplied on a tangible medium once performance has begun with your prior express consent and your acknowledgement that you thereby lose the right of withdrawal. Credits are made available in your account immediately after payment.
  • Account connections: under art. 16(a) of OUG 34/2014, the right of withdrawal does not apply once the service has been fully performed, if performance began with your prior express consent and acknowledgement that you lose the right once the contract is fully performed. If you withdraw within 14 days of concluding the contract, before the first subscription period ends, you owe an amount proportional to the service supplied up to the moment you told us you were withdrawing (art. 14(3) of OUG 34/2014) and the rest is refunded; the subscription ends. Later monthly renewals are not new contracts; you can stop them at any time by cancelling the renewal (section 4), effective at the end of the period already paid.

Before paying you are asked to tick an express consent to the immediate start of performance and the acknowledgement of losing the right of withdrawal; the payment cannot start without it. The time of consent and the version of the Terms accepted are recorded with the order. To exercise the right of withdrawal (where it applies), send an unequivocal statement to contact@postingclips.com identifying the order. Refunds are made with the same payment method, within 14 days of receiving the request.

Apart from the cases above and the rights the law gives you (including for lack of conformity of digital content or services under OUG 141/2021), amounts paid are not refunded.

7. AI-generated content

  • Clips, images, texts written on clips, post captions and suggested edits are generated automatically by AI models of third-party providers (listed in the Privacy Policy). The output may be inaccurate, incomplete, unexpected or similar to existing material. We do not guarantee that any output will meet your expectations, be original or fit a particular purpose.
  • Check every clip and every text before it is published. You decide what is published and you are responsible for the content published on your accounts, including the claims it makes, advertising rules and the platforms’ rules.
  • Where the platforms require it, we label AI-generated clips as such when publishing. Do not remove or hide these labels and do not present generated content as real where that could mislead.
  • As between you and us, you may use the generated output for any lawful purpose, including commercial use, subject to the rights of the model providers and of third parties in the source material. Stock footage is subject to the licence of the library it comes from.
  • The video editor is free. The AI assistant inside the editor (written commands, the automatic “Edit automatically” edit and automatic subtitles) is paid in credits on each use, at the prices in section 4, also shown on its buttons; credits are only taken when the action succeeds. The result is a suggested edit that you review and can change before saving; subtitles may contain speech-recognition mistakes. The music in the editor’s library is in the public domain (CC0 1.0): you may use it in clips, including commercial ones, without attribution. The editor’s sound effects are also in the public domain (CC0 1.0). The emoji are Google’s Noto Emoji artwork, under the Apache License 2.0 (licence text: /emoji/LICENSE.txt). The text fonts come from Google Fonts, under the SIL Open Font License 1.1 or the Apache License 2.0 (list: /fonts/editor/LICENSES.txt); you may use them in clips, including commercial ones.

8. Material you upload

  • You keep all rights in the clips, images, photos (including those used for avatars) and text you upload or enter (“Your Material”).
  • You represent and warrant that you hold the necessary rights (copyright, trade marks, image rights and the consent of the people shown) to use and publish Your Material and that it does not break the law or infringe anyone’s rights. Do not upload photos of people without their consent.
  • You grant us a non-exclusive, royalty-free, worldwide licence, for as long as you use the Service, to store, process, transform and transmit Your Material (including to the AI providers and to the social networks you choose) solely to provide the Service to you. We do not use Your Material to train AI models.
  • Keep copies of anything important: the Service is not an archive, and clips may be deleted after an account is closed.

9. Publishing to social networks

  • By connecting a social account you authorise us (together with our publishing provider) to publish the clips and captions you schedule to that account on your behalf and to read the posts’ statistics. You can disconnect an account at any time in the app or in the platform’s settings.
  • Your use of each social network remains subject to that platform’s terms. We are not responsible for the platforms’ decisions (for example removing a post, limiting its reach, suspending an account), for outages or changes in their interfaces, or for the results of posts (views, followers, sales).
  • Publishing happens straight away or at the date and time you set (from the Calendar or an automation); a scheduled post can be moved or cancelled from the Calendar before it goes out. For technical reasons (platform limits or errors) a post may be delayed or may fail. The status of every post is shown in the app.

10. API keys

You can create API keys that give read access to your posts and their statistics. A key is shown only once; keep it confidential — you are responsible for its use. You can revoke it at any time in the app, and we may revoke it in case of abuse or a security risk.

11. Acceptable use and moderation

You may not use the Service to create, upload or publish content that:

  • is unlawful, defamatory, threatening, harassing, incites hatred or violence or promotes terrorism;
  • involves minors in a sexual context or any form of exploitation or abuse;
  • is sexually explicit, or is a “deepfake” of a real person made without their consent or intended to mislead;
  • infringes copyright, trade marks, image rights or the privacy of others;
  • is spam, a scam, misleading advertising or malware;
  • breaks the rules of the platforms it is published on.

You may also not try to bypass technical or payment limits, access our systems without authorisation or overload the Service. AI providers may automatically refuse certain requests. We may remove content that breaks these rules and may suspend or close the account, in proportion to the seriousness of the breach, normally telling you the reasons. You can contest such a decision at contact@postingclips.com. Illegal content can be reported to the same address.

12. Availability and changes to the Service

We make reasonable efforts to keep the Service running, but interruptions may occur for maintenance, because of third-party providers (AI, storage, social networks, payments) or for reasons beyond our control. We may improve, change or withdraw features; if we withdraw an essential feature you have paid for and it can no longer be used, we refund the unused part proportionally.

13. Liability

  • The Service is provided with professional diligence, but without guarantees as to the commercial results of posts or the accuracy of AI-generated content.
  • To the extent permitted by law, we are not liable for indirect loss (for example lost profit, lost followers or opportunities) or for the acts of social platforms or other third parties. For users who are not consumers, our total liability is limited to the amounts they paid in the previous 12 months.
  • These limitations do not apply to intent or gross negligence, to harm to life, body or health, and do not restrict the rights that the law gives consumers and that cannot be excluded by contract.
  • You are liable to us for loss caused by breaching these Terms, in particular through Your Material or content published at your request.

14. Personal data

We process personal data as described in the Privacy Policy and use cookies as described in the Cookie Policy.

15. Changes to the Terms

We may update the Terms, for example when the Service or the law changes. The version and effective date are shown at the top of the page. Significant changes are notified by email or in the app at least 15 days before they take effect; if you disagree, you can close your account before that date. Paid orders remain subject to the version accepted at the time of payment.

16. Governing law and disputes

The Terms are governed by Romanian law. If you are a consumer, you also keep the protection of the mandatory rules of the country where you habitually live. Please contact us first at contact@postingclips.com so we can try to settle any issue amicably. Disputes that cannot be settled amicably fall under the competent Romanian courts; consumers may also bring proceedings in the courts where they live, as the law allows.

Consumers may file complaints with the Romanian National Authority for Consumer Protection (ANPC, anpc.ro) and use alternative dispute resolution (SAL) under Government Ordinance 38/2015: anpc.ro/ce-este-sal.

17. Final provisions

If any provision of the Terms is held invalid, the others remain in force. A delay in exercising a right is not a waiver of it. We are not liable for failure to perform caused by force majeure. Notices are sent by email, to the account’s address and to contact@postingclips.com respectively.
